Fake Intel Report: Summoned Odisha BJP Leader’s Lawyer Responds To Commissionerate Police Notice

**Bhubaneswar:** Responding to the notice served by the Commissionerate Police to Odisha BJP vice-president Samir Mohanty to depose at Kharabela Nagar Police Station (PS) with the document related to the intelligence report claimed to be of State Special Branch shown by at a BJP press conference on Monday, Mohanty’s lawyer complied it today on behalf of his client.

Speaking to media, Mohanty’s lawyer Partha Sarathi Nayak said, “In accordance with 91 CrPC, police had issued notice to Samir Mohanty for some documents to be produced. Samir Mohanty has placed before the police all his answers in writing. All sorts of cooperation will be extended to the police in the investigation.”

“Police wanted to know about the source of the document (intelligence report in question). The source has been disclosed in writing by my client (Odisha BJP vice-president Samir Mohanty),” the lawyer informed.

Notably, a notice under Section 91 of CrPC was issued against Samir Mohanty to depose before IIC of Kharabela Nagar PS today (Thursday).
The notice read, “You are here by directed to produce the documents before me on dated 21.03.19 at Kharabela Nagar Police Station at 10 AM for the purpose of investigation under the chapter XII of CrPC.”

Mohanty had been asked to produce the original letter, bearing number SIB PD (CMO) 364/2019, dated 15.03.2019, signed off by the Special DG of Police, Intelligence, which was exhibited during the press conference held at BJP party office in Bhubaneswar on Monday (March 18) evening.

**As per Section 91 in the Code Of Criminal Procedure (CrPC), 1973**

**(1) ** Whenever any Court or any officer in charge of a police station considers that the production of any document or other thing is necessary or desirable for the purposes of any investigation, inquiry, trial or other proceeding under this Code by or before such Court or officer, such Court may issue a summons, or such officer a written order, to the person in whose possession or power such document or thing is believed to be, requiring him to attend and produce it, or to produce it, at the time and place stated in the summons or order.

**(2) ** Any person required under this section merely to produce a document or other thing shall be deemed to have complied with the requisition if he causes such document or thing to be produced instead of attending personally to produce the same.
