Bhubaneswar: The designated court under the OPID Act, Cuttack, has passed an ad-interim order of attachment absolute (confirmed) of the properties of M/s Surya Nirman Resources Private Ltd, and directed the competent authority, i.e. ADM-cum-Competent Authority under the OPID Act, Cuttack, to sell the immovable properties through public auction for equitable distribution of the proceeds among the realty firm’s investors/depositors.
According to EOW, Bhubaneswar, a case was filed against M/s Surya Nirman Resources Private Ltd, its MD, Chinmay Mallick, and directors Rojalin Mallick and Biswajit Pattnaik at the EOW police station on May 29, 2017, under Sections 467/468/471/ 420/406/120-B IPC r/w Section 6 of OPID Act, 2011, for collecting public deposits of more than Rs 2 crore with the promise of providing them litigation-free plots/land at Chandaka or pay back the invested amount with high returns through its different money-back policy/schemes.
However, the company neither provided the land/plots nor did it return the promised amount with returns to the investors/depositors, and misappropriated the amount.
During 2010-15, the directors of M/s Surya Nirman Resources (P) Ltd. floated different plans/schemes and collected public deposits to the tune of more than Rs 2 crores from more than 100 persons, without any authority to provide litigation-free plots/land at Chandaka. The amount was collected by inducing the general public through the distribution of colourful brochures containing different lucrative/attractive schemes, leaflets, etc. apart from personal motivation/inducement by the agents of the company.
Acting on the complaints lodged by the investors/depositors in this connection, the EOW, Bhubaneswar, launched an investigation into the matter and collected the details of moveable/immoveable properties standing in the name of the company and its directors from IGR, Cuttack.
The landed properties included Ac. 17.468 decimal land at Krushna Nagar, Chandaka, Kantabada in Khurda district, and Kujanga and Padampur in Jagatsinghpur district.
An ad-interim proposal for attachment of the above landed properties worth Rs 2,07,85,349 was submitted by EOW on March 7, 2018, under the provision of Section3 of OPID Act to the Finance Department, Government of Odisha, and accordingly these landed properties were attached by the on April 9, 2018.
