Bhubaneswar: Acting on orders passed by the Judicial Magistrate under Section 83 CrPC, Ganjam police have taken action in four cases wherein the accused persons are absconding.
Section 83 CrPC states that “Attachment of property of person absconding. (1) The court issuing a proclamation under Section 82 may, for reasons to be recorded in writing, at any time after the issue of the proclamation, order the attachment of any property, movable or immovable, or both, belonging to the proclaimed person…”
Four police stations in Odisha’s Ganjam district have seized the movable properties of the absconding accused persons. These cases were registered with Pattapur, Kodala Bhanjanagar, and Jagannath Prasad police stations. Of the four cases, one is a murder case, one rape case and the other two others are attempt to murder cases.
Details of these cases are given below:
Niranjan Mandal, accused of murder and the case registered at Pattapur police station (Case No. 115/2020 under Sections 342/364/302/201/120(B) IPC, has been absconding soon after committing the alleged crime. On April 10, 2023, under the supervision of SDPO, Aska, Pattapur IIC executed the process issued by the court under Section 83 CrPC and seized the movable properties and household articles of the absconding accused. On the impact of such action, the accused surrendered before the court of the Gram Nayalaya- cum-JMFC, Sanakhemundi on April 18, 2023.
In the second case (Case No.146/2017 (G.R No.163/2017) under Sections 341/323/294/337/307/506/34 IPC), the accused Bisikesan Das and Kabuli Das were allegedly involved in a case registered with the Kodala police station and have been absconding since the incident. On April 12, 2023, IIC Kodala PS and staff, executed the process issued by court U/s 83 CrPC and seized the movable properties from the house of the absconding accused persons in presence of Tahasildar, Kodala, and under the supervision of SDPO, Purushottampur. On the impact of such action, the absconding accused Kabuli Das surrendered before IIC Kodala PS on April 13, 2023 and is now in judicial custody.
Magata Sahu, accused in a serious rioting case (Case No. 57/2004 under Sections 147/148/307/325/324/506/427/149 IPC) registered at the Bhanjanagar police station has been absconding since 2004. On April 11, 2023, IIC Bhanjanagar PS, under the supervision of SDPO, Bhanjanagar, executed the process issued by the court under Section 83 CrPC and seized the movable properties and household articles from the house of the absconding accused.
In another case, one Rajesh Naik is accused in a rape case (Case No. 41 Dt.06.04.2017 under Section 376(2)(i)(n)/294/506/34 IPC/6 POCSO Act) vide Jagannath Prasad PS. The accused has been absconding soon after the crime. On April 14, 2023, IIC, Jagannath Prasad PS, under the supervision of SDPO, Bhanjanagar, executed the process issued by the court under Section 83 CrPC and seized the movable properties including the household articles of the absconding accused.
