Bihar: Patna HC Grants Anticipatory Bail To RJD MLA In Siwan Land Case

Patna: Rashtriya Janata Dal (RJD) MLA Osama Shahab, who represents the Raghunathpur Assembly constituency in Siwan district, received major legal relief on Tuesday after the Patna High Court granted him anticipatory bail in a land dispute case.

With the latest order, the immediate possibility of his arrest has been ruled out, replacing the interim protection that the court had earlier granted.

The case concerns a disputed parcel of land in Jhunapur village, under the jurisdiction of Mahadeva Police Station in Siwan district.

On April 15, 2026, Sudha Singh, a resident of Gopalganj, and her husband, Vinay Kumar Singh, lodged an FIR alleging that Osama Shahab obstructed construction work on land they had purchased in September 2024, claiming ownership over the property.

According to the complaint, the complainants initially received phone calls asking them to stop construction. Later, a group of 30-40 people allegedly arrived at the site.

The group allegedly assaulted labourers working there, CCTV cameras were reportedly vandalised, and mobile phones and a cutter machine were allegedly snatched.

Based on these allegations, the Mahadeva Police registered an FIR against Osama Shahab, Farhan, Sabir, and 30–35 unidentified persons under various legal provisions.

A court in Siwan had rejected Shahab’s anticipatory bail application on April 28, 2026. He subsequently approached the Patna High Court seeking relief.

During the proceedings, the High Court called for the police case diary and granted an interim stay on his arrest, preventing coercive action while the matter was under consideration.

Before the High Court’s interim protection was issued, a police team led by SDPO Ajay Kumar Singh visited Shahab’s residence in Patna’s Kotwali police station area. However, the MLA was not present. His associates informed the police that the High Court had already stayed his arrest and produced the relevant court order.

Presenting his defence before the court, Osama Shahab argued that the disputed land had been registered in his wife Ayesha’s name in January 2023, and that construction was stopped because the ownership dispute was already sub judice.

A second sale deed was allegedly executed later in favour of Vinay Kumar Singh and Sudha Singh, leading to the present dispute.

After hearing both sides on Tuesday, the Patna High Court granted anticipatory bail to Osama Shahab.

The order converts the earlier interim protection into regular legal relief, ensuring that he will not be arrested in connection with the case while complying with the conditions of bail.

However, the court’s order does not end the case. The police investigation will continue, and the legal proceedings regarding the land dispute will proceed in accordance with the law.
