Bhubaneswar: The Orissa High Court has recently ordered the seizure of a Chinese ship (MV ZHE HAI 505) (IMO number-9567477) anchored at Paradip Port.
If the seizure order is not issued, the ship is likely to leave Paradip Port. Therefore, the Court has clarified to arrest the ship immediately, said sources.
The single bench of the High Court comprising Justice V. Narasingh passed the decree in favour of Scandi Trading Limited asking the Chinese ship to settle a claim of Rs 99.81 lakh for low supply of goods under Section 4 (1)(l) of the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017.
According to sources, a dispute arose between the petitioner trading company and the ship’s owner over the low supply of sulphur marine gas oil. The ship’s owner was supposed to pay the petitioner trading company ₹99,81,553. However, since the ship’s owner failed to pay, the petitioner trading company approached the High Court.
The case was filed under the Admiralty Act (Jurisdiction and Settlement of Maritime Claims) 2017, Section (4)(1)(A).
The court’s direction came after hearing the petitioner’s arguments and reviewing the submitted documents. The Court found prima facie evidence and deemed the case worthy of trial.
