Bhubaneswar: The State Government has amended the Odisha Real Estate (Regulation and Development) Rules, 2017 to prevent real estate agencies from cheating buyers by charging extra fees. As per a gazette notification issued by the Housing & Urban Development Department on Monday, the rules will be now called the Odisha Real Estate (Regulation and Development) Amendment Rules, 2022.
Under the amended rules, real estate agencies can’t collect Goods and Services Tax, Cess, and other taxes from the house/landlord. They cannot take any taxes except the house price. If certain tax regimes change in the future, additional taxes will be paid by the buyer. The real estate agency will estimate the cost of the home including construction costs and taxes.
However, if the contract ends later than the scheduled time, the buyer will not pay more for the house. The buyer or allottee could use the Common Areas along with other occupants, maintenance staff, etc., without causing any inconvenience or hindrance to them. The seller cannot charge extra for fire extinguishers installed in public areas. It should be included in the price of the house.
After getting the occupancy certificate, the seller should hand over the public space to the association formed by the home buyer. The buyer will pay the maintenance fee after staying in the house.
